SC Stays Capital Punishment of Six Mumbai Blasts Convicts: TADA Court Hard Work gets Futile

Who is Abdul Ghani Turk?

Abdul Ghani Turk is a person who was convicted by Mumbai TADA court for his role in 1993 Mumbai serial blasts and awarded him death penalty.

A bench headed by Chief justice of India K.G. Balakrishnan has ordered the stay of punishment after hearing petition of convict to challenge his conviction by TADA court.

The bench which included Justice R.V. Raveendran and Justice M.K. Sharma has issued a notice to CBI on the issue.

The honorable court also heard the petition filed by another convict with life imprisonment Shaikh Ali Shaikh Umar and also issued notice in his regard.

It is to remember here that Turk was the sixth convict facing death sentence in Mumbai Serial blasts cases out of 12 Convicts by Indian Supreme Court of India.

The earlier list includes

1.    On Jan 28, 2008 Apex Court suspended death sentences of Yakub Memon.

2.    Mohammed Shoaib Ghansar got Relief from Indian Highest Court on Feb 21.

3.    April 4 Supreme Court also stayed the capital punishment to Zakir Hussain Noor Mohammed Sheikh.

4.    On April 7, 2008 Mohammed Mushtaq Moosa Tarani and Asgar Yusuf Mukadam got stay order against their conviction from Supreme Court.

The Convicts who has not filed petitions Supreme Court of India but can be benefited by earlier stayed orders of Apex Court are as under.

1.    Pervez Sheikh,

2.    Shahnawaz Qureshi,

3.     Iqbal Yusuf Shaikh,

4.    Feroz Malik,

5.    Abdul Khan and

6.    Farooq Pawle.

The Mumbai blasts were occurred in March 12, 1993 and claimed at least 257 lives and injured overs 713 citizens.A Special TADA Court was established for trial of all cases related to serial blasts which had delivered its decision on in July 2007 after long 14 years.

The Judge P D Kode was designated as a special TADA judge on March 29, 1995 and Public Prosecutor Ujawal Nikam had lived life of prisoner in for long 14 years as Special TADA court is situated in a separate building inside the premises of the Central Jail at Arthur Road.

The Court had Taken Witness of 700 witnesses, and recorded 35,000 documents to come into its decision on the cases.

A family member of Mumbai blasts told ABC Live All hard work done by special court and its Public Prosecutor seems to be weathering away as all convicts are getting relief from Highest Court of India in the name of natural law of justice.
